" Happy Together " is a song by American rock band, Turtles from Happy Together album (1967). The song was written by Garry Bonner and Alan Gordon, a former member of The Magicians. The song has been rejected a dozen times before the song was offered to the Turtles, and the acetate demo was extinct.

Released as a single in February 1967, the song knocked The Beatles "Penny Lane" out of number one slot on the US Billboard Hot 100 and remained above the chart for three weeks. It was the only group chart-topper in the United States. "Happy Together" also reached number 12 on the UK Singles Chart in April 1967 and number 13 on the Top 100 Singles of 1967 in Canada.

Copyright claim

Flo & amp; Eddie, the legal successor to Turtles, filed a lawsuit in the New York Court of Appeals against Sirius XM Radio to make common law copyright on their original recording of "Happy Together." Because the song was recorded in 1967, five years before the federal vote was set, the group sought to establish that it was protected by common law copyright, a cryptic form of copyright held at the state level, in the hope of generating royalties from Sirius XM ( because they do not write songs, they can only accept performance royalties). The Court of Appeals has previously ruled that such common law copyright may exist for record sales in New York in 2005's ruling Capitol Records, Inc. v. Naxos of America, Inc. .

On December 20, 2016, the Court ruled that there is no such common law copyright in New York for public recording of sound recording, and that Flo & amp; Eddie can not claim royalties.
